Where is a North Port DUI case heard?

North Port is in Sarasota County, so a North Port DUI is a Sarasota County case, not a Charlotte County case. Under Twelfth Circuit Administrative Order 2026-12.2, the Sarasota clerk dockets traffic and misdemeanor cases arising south of Blackburn Point Road at the South County Courthouse, 4004 South Tamiami Trail, Venice. North Port is in that district. For most North Port residents, the drive is to Venice, not downtown Sarasota.

Felony DUI charges are heard at the Judge Lynn N. Silvertooth Judicial Center, 2002 Ringling Boulevard, Sarasota. These include a third DUI within 10 years, a fourth or later DUI, DUI with serious bodily injury, and DUI manslaughter (s. 316.193). Who makes DUI arrests in North Port?

North Port Police Department. This is the primary agency inside the city limits.
Florida Highway Patrol, Troop F. FHP covers Sarasota County and commonly handles crashes and stops on I-75, which runs through North Port.
Sarasota County Sheriff's Office. The Sheriff's Office patrols unincorporated areas near the city and runs the county jail.

The Sheriff's Office notes that several area law enforcement agencies bring arrestees to the Sarasota County jail at 2020 Main Street in Sarasota. Reports for those arrests come from the arresting agency's records section. For a North Port Police arrest, request records from North Port PD, not the Sheriff. The Sheriff's Office describes its booking area as set up for arresting agencies to run Intoxilyzer breath tests in DUI cases. That is one reason a North Port arrest can involve a long ride north before any breath test.

The time between stop and test

Because of the distance between North Port and the downtown jail, the time between driving and testing can be longer than in a downtown case. Florida's per se offense is having a breath or blood alcohol level of 0.08 or higher (s. 316.193(1)). The State must still connect a later test to the time of driving. The timing of the stop, the transport, the 20-minute observation period and the two breath samples required under FDLE rule 11D-8 are all worth documenting. License deadlines after a North Port DUI

An officer who finds a breath level of 0.08 or higher, or records a test refusal, usually issues a notice of suspension that serves as a 10-day temporary permit. Under section 322.2615, you have 10 days to request a formal or informal review, or to ask about a restricted license. Suspensions are:

6 months for a first unlawful-BAC suspension.
1 year for a first refusal.
18 months after a prior refusal suspension.

A first refusal is also a second-degree misdemeanor under section 316.1939, as amended in 2025. A refusal after a prior refusal suspension is a first-degree misdemeanor. Read the 10-day rule, refusing a breath test and hardship license.

Penalties on conviction

For a first conviction, section 316.193 provides:

A fine of $500 to $1,000 and up to 6 months in jail.
A fine of $1,000 to $2,000 and up to 9 months if the BAC was 0.15 or higher or a minor was in the vehicle.
Probation of up to 1 year, 50 hours of community service, DUI school, and 10 days of vehicle impoundment or immobilization.

Section 322.28 adds a court-ordered license revocation of 180 days to 1 year, and adjudication cannot be withheld (s. 316.656). A second conviction within 5 years requires at least 10 days in jail and at least a 5-year revocation. See first DUI, second DUI and high BAC.

Frequently asked questions

Is a North Port DUI handled in Charlotte County?

No. North Port is in Sarasota County. Misdemeanor DUI cases from North Port are normally docketed at the South County Courthouse in Venice, and felony cases are heard in downtown Sarasota.

Where do I get the police report and video?

From the arresting agency. For a North Port Police arrest, that is North Port PD's records section. For an FHP arrest, requests go to FHP. Your attorney can also get records through discovery.

Why was my breath test done in Sarasota?

Arrestees are booked at the Sarasota County jail on Main Street, which the Sheriff's Office says has a pre-booking area for DUI breath testing. The test location and timing should be in the reports.

Do I have to go to court in person?

It depends on the hearing and the judge's orders. Hiring a lawyer does not automatically excuse an appearance. Confirm every date with your attorney.
