Public Defender vs. Private DUI Lawyer in Sarasota
The Public Defender's Office for the Twelfth Judicial Circuit handles a large share of the DUI cases in Sarasota and Manatee County, and the lawyers who work there are real trial lawyers who know the judges, the prosecutors and the local practice. If you cannot afford to hire counsel, apply for the public defender and do not let anyone talk you out of it. The useful comparison is not about the quality of the lawyer. It is about three practical differences: who is eligible, what the representation covers, and how much of the lawyer's time one DUI case can get. This page lays those out so you can decide.
Who qualifies for the public defender
The public defender is not free for the asking; you have to be found indigent. Under section 27.52, you file an application with the Clerk and pay a $50 application fee, and the Clerk determines whether you qualify. The income standard is 200 percent of the federal poverty guidelines; income above that line generally means you are not indigent, and owning property with a net equity value of $2,500 or more, not counting your homestead and one vehicle worth up to $5,000, creates a presumption against indigency. Many working people with a DUI arrest fall above the line, which is why the question comes up at first appearance or arraignment and the answer is often no.
If you are found indigent and the case ends in a conviction or a plea, including a plea with adjudication withheld, section 938.29 requires the court to assess public defender fees and costs of at least $50 for a misdemeanor and $100 for a felony, and the judgment is a lien that follows you until it is paid. The public defender is inexpensive, not free.
What the public defender does and does not cover
A public defender represents you in the criminal case: arraignment, discovery, pretrial conferences, motions, plea negotiations and trial. That is the same courtroom work a private lawyer does.
What the public defender's office does not handle is the separate administrative case over your driver license. The formal review hearing at the Florida Department of Highway Safety and Motor Vehicles is a civil proceeding, not part of the criminal case, and it has to be requested within 10 days of the arrest. If you are waiting for the public defender to be appointed, that deadline passes. This firm's flat fee for a DUI always includes the license hearing, and the hearing is also where the arresting officer first testifies under oath, which feeds directly into the criminal defense.
Caseloads and time
The office's attorneys carry heavy caseloads, which is a budget fact, not a criticism. A DUI defense that produces a reduction or a dismissal is built on time-consuming work: watching every minute of the body camera and dash camera video, pulling the Intoxilyzer 8000 inspection records from the Florida Department of Law Enforcement, checking the breath test operator's permit, lining up the stop against the dispatch log, and, in some cases, hiring a forensic witness on breath testing or field sobriety tests. A private lawyer with a smaller caseload can spend that time on one case; a lawyer with hundreds of open files has to choose. Private forensic witness fees are also a cost the public defender's office may not be able to absorb in a misdemeanor case.
Access and communication
With a public defender, you are often meeting your lawyer for the first time at the courthouse, and you cannot pick who is assigned. With a private lawyer you choose who you are hiring, you talk before the first court date, and the questions that come up at 9 p.m. on a Saturday, about a release condition, a hardship license application or a DUI school deadline, get answered. Calls and texts to this office are answered nights and weekends because that is when DUI questions happen.
The "I'll just plead guilty" trap
The most expensive decision in a DUI case is a quick guilty plea, with or without a lawyer. Under section 316.656 a DUI conviction cannot be withheld and can never be sealed, and it carries a license revocation under section 322.28, mandatory penalties under section 316.193, and years of insurance consequences. Most first-offense cases in Sarasota and Manatee County can instead be resolved through the DETER program, a negotiated reduction to reckless driving, or a dismissal when the stop or the test does not hold up. A lawyer who has the time to review the evidence before arraignment is how those outcomes happen. See can a first DUI be reduced in Sarasota.
What a private DUI lawyer costs here
This firm charges a flat fee for the criminal case that includes trial, and the DUI flat fee includes the administrative license hearing. The planning range for a standard first-time DUI is on the cost of a DUI lawyer in Sarasota page, with a Bradenton version at cost of a DUI lawyer in Bradenton, and payment plans are available. Compare that number against what a conviction costs over the next few years in insurance, interlock, license fees and employment consequences, not against zero.
When the public defender is the right call
If you meet the indigency standard and a private fee is out of reach even on a payment plan, apply for the public defender at your first court date and request the application fee be handled with your case costs. Do not plead guilty at arraignment to avoid the application. And even with a public defender on the criminal case, file your own request for the formal review hearing within 10 days, or hire a lawyer for that piece alone, so the license is not lost by default.
Questions people ask
Can I switch from the public defender to a private lawyer later?
Yes. A private attorney files a notice of appearance and substitution, and the public defender is discharged. The earlier the switch, the more of the evidence review happens before decisions get made.
Can I have a private lawyer for the license hearing and the public defender for the court case?
Yes. The license hearing is a separate administrative proceeding, and representation there does not depend on who handles the criminal case.
Are public defenders good lawyers?
Yes. Public defenders are licensed Florida attorneys, and many have more trial experience than much of the private bar. The differences are eligibility, scope and time, not credentials.
Will the judge appoint the public defender for a first DUI?
Only if the Clerk's indigency determination says you qualify under section 27.52. A first offense does not change the income test.
How does a flat fee compare to hourly billing?
A flat fee means the price is set at the start and does not grow with the number of hearings or a trial. The written fee agreement spells out what is covered, including the license hearing.
Does the firm handle Bradenton cases too?
Yes. Sarasota and Manatee County are both in the Twelfth Judicial Circuit, and the firm appears in both courthouses. See Bradenton DUI lawyer.
