Florida DUI 10-Day Rule

Explaining 10 day rule DUI Florida, Florida DUI license suspension, Hardship license, and Formal Review Hearing

 Hardship License

If you refused a breath test or blew over .08, you only have 10 days to apply for your hardship license after a Florida DUI arrest! You must also register for DUI school in the county you live in to obtain your hardship license. If you do nothing, your license will likely be suspended automatically by the Florida Department of Highway Safety and Motor Vehicles (DHSMV).

Alternatively, you may want to dispute the suspension on your license and request a formal review hearing with the DMV. This is most commonly done when the client has prior DUI convictions and is not eligible for a hardship license. This strategically may be a good idea if there are weaknesses in the DUI case and gives us, the DUI attorney, a opportunity to ask the arresting DUI officers questions in a formal hearing that is recorded.

Formal Review Hearing in Florida DUI Cases (License Suspension Defense)

If you were arrested for DUI in Florida, you may be able to request a formal review hearing to challenge your license suspension.

This is a separate process from your criminal case and must be requested quickly.

If you do not act within 10 days of your arrest, you may lose the ability to challenge the suspension.

What Is a Formal Review Hearing?

A formal review hearing is an administrative hearing held through the Florida Department of Highway Safety and Motor Vehicles (DHSMV).

It allows you to challenge whether your license suspension was valid after a DUI arrest.
