First Sarasota DUI? What am I facing?

First offense DUI Florida penalties

First DUI in Sarasota: Court Preparation and License Deadlines

After a first DUI arrest in Sarasota County, confirm your next court date, read your release conditions and check any driver-license suspension notice immediately. The criminal case and the administrative license process are separate; waiting for arraignment can leave an earlier deadline unaddressed.

This page explains local preparation and resources. If the arrest occurred in Manatee County, the Bradenton guide below addresses that court system.

Start with Florida’s first-DUI penalty framework

Sarasota applies Florida’s DUI law. A first conviction may involve fines, probation, education, community service, vehicle immobilization, license revocation and possible jail. The BAC allegation, a minor passenger, a crash and prior convictions can change the penalties.

Read the statewide first-DUI penalties guide for the legal framework. This local guide focuses on what to organize and where to find reliable Sarasota court information.

Check the suspension notice before the court date

The deadline to request formal or informal administrative review generally runs 10 days from issuance of the suspension notice under section 322.2615. The suspension begins when the notice is issued; an eligible driver may receive a temporary permit.

Ask counsel about review and restricted-license eligibility. A later court appearance does not extend this deadline, and a temporary permit does not give every driver unrestricted permission to drive.

Confirm the courthouse and appearance requirements

The Lynn N. Silvertooth Judicial Center is at 2002 Ringling Boulevard in Sarasota. Use your hearing notice to confirm the assigned location, courtroom, time and whether the appearance is in person or remote.

Our Sarasota criminal court guide collects official case-search, courthouse and hearing-preparation resources. Do not rely on a general website address instead of your case-specific notice.

Organize the facts for an evidence review

Bring the citation, release paperwork, suspension notice and any test documents. Write down your recollection while it is fresh and tell counsel about potential witnesses or recordings. Share details privately and preserve original files.

Questions for counsel include the reason for the stop, field-exercise conditions, the timing and administration of testing, and what video or other records should be requested.

Discuss defense options before deciding on a plea

The first meeting should address both the evidence and the practical consequences for your work, transportation and record. A breath result alone does not answer every legal question. Counsel can explain which issues warrant investigation and what a proposed resolution would require.

Do not assume that a first offense guarantees a reduction or that contesting a test guarantees dismissal. Some first-time, non-aggravated DUI cases in Sarasota County may be reviewed for DETER, the State Attorney’s DUI diversion program. Eligibility is decided by the prosecutor, and it is not a dismissal. See the DETER program.

A documented Sarasota DUI disposition

Our selected case results include a March 2025 Sarasota County DUI/unlawful-BAC matter in which the State declined prosecution without prejudice. The linked redacted record documents the disposition; it does not establish first-offense status or explain the prosecutor’s reasoning.

Past results do not guarantee a similar outcome. A disposition without prejudice may permit later prosecution. Each case requires its own evidence review.

Budget for representation and related expenses

Ask which proceedings the proposed fee covers, whether driver-license review and trial are included, and how payment arrangements work. Court costs, education or treatment, insurance and reinstatement expenses are separate questions.

Use the firm’s fee information to prepare for a clear discussion of services and payment options.

A practical first-week checklist

  • Calendar the hearing date and any deadline on the suspension notice separately.

  • Keep copies of release conditions and comply with them.

  • Confirm driving eligibility before driving.

  • Preserve documents and recordings for counsel.

  • Discuss the charge, license issues and scope of representation.

First-DUI questions in Sarasota

Will every first DUI require jail?

No. Incarceration is possible, but an ordinary first DUI does not carry a mandatory minimum jail term under section 316.193(2). Aggravating facts and other charges can change the analysis.

Is the court revocation the same as the arrest suspension?

No. A first conviction generally brings a 180-day to one-year revocation, except a violation resulting in death, under section 322.28. The administrative suspension has separate grounds and procedures.

Can my lawyer attend court for me?

Ask counsel to confirm your obligations for each hearing. An appearance waiver is not automatic.
