Arrested for DUI While Visiting Sarasota: A Guide for Out-of-State Drivers

Going home after a Sarasota DUI arrest does not end the Florida case or stop its deadlines. An out-of-state driver may need to address the criminal case, Florida driving privileges, and possible consequences in the state that issued the license. These questions should be evaluated separately.

What should I check before leaving Florida?

Read the bond or release order, citation, suspension notice, and notice of your next appearance. Confirm whether any travel restriction applies. Do not assume a scheduled flight excuses a required court date. Give counsel reliable contact information and tell counsel where you will be living.

Keep legible copies of every document. Record the arresting agency, case number, dates, and the location of any impounded or rental vehicle. Arrange lawful transportation if your driving privileges are uncertain.

Does Florida's 10-day deadline apply to visitors?

A Florida DUI-related administrative suspension requires prompt review even when your license was issued elsewhere. Section 322.2615 provides a 10-day period after issuance of the suspension notice to request administrative review. The notice, eligibility, and available options should be evaluated immediately. Do not wait until you return home or until the first criminal court date.

Will my home state suspend my license?

That depends on the home state's law and the disposition or information reported. Florida's Driver License Compact provides for reports of qualifying convictions to other participating states. You should not assume a Florida case stays in Florida or that every state imposes identical consequences.

Florida counsel can address the Florida proceeding. Advice about the issuing state's licensing rules may require that state's licensing agency or a lawyer there. Confirm your status before driving in either state; possessing the physical license card is not proof that all driving privileges are valid.

Will I have to return for court?

Required attendance depends on the proceeding and the court's rules and orders. Ask whether counsel can handle a particular appearance, whether a waiver is available, or whether remote participation is authorized. Get a clear answer for each date. Hiring a local lawyer does not automatically waive every personal appearance.

Can I complete classes or probation at home?

Do not enroll in an outside program assuming Florida will accept it. Obtain guidance about approved providers and required permission first. Supervision, travel, community service, testing, and other conditions may need specific arrangements. A proposed plan should identify where each requirement can lawfully be completed and how completion will be documented.
